Keen to better meet the expectations of its customers, 44 GALERIES LAFAYETTE – 44 GL (hereinafter referred to as “Galeries Lafayette”), a simplified limited company (société par actions simplifiée) with share capital of €147,184,338, having its registered office at 44-48, rue de Châteaudun – 75,009 PARIS, identified under number 552 116 329 RCS PARIS, offers a loyalty programme to its customers.
The purpose of these general terms and conditions is to define the rights and obligations of Galeries Lafayette and its customers in the context of the operation of the Mes Galeries loyalty programme. For more information, contact 09 69 39 75 75 (standard rate call).
2. Purpose of the loyalty programme
The purpose of the Mes Galeries loyalty programme is, under the conditions set out in these general conditions, to accumulate points and offer its members a certain number of preferential advantages.
3. Loyalty programme scope of validity
The loyalty programme is valid in all the “Galeries Lafayette”, “Nouvelles Galeries” and “Galeries Lafayette Outlet” stores in France, operated directly or by a company linked with the Galeries Lafayette Group by a commercial affiliation agreement (hereinafter, “the Stores” or “Store”), on the www.galerieslafayette.com site and on the Galeries Lafayette mobile app (hereinafter, “Website”) with the exceptions indicated and the “Opera” store. The loyalty programme applies to purchases made in the stores listed above, net of discounts and reductions, excluding the list service, Le Voyage, catering, services, gift cards and other indicated exceptions.
The loyalty programme cannot be combined with the tax refund offer proposed by Galeries Lafayette.
Special terms and conditions apply to employees of the Galeries Lafayette group.
4. Loyalty programme membership conditions
The loyalty programme is accessible subject to membership of the Mes Galeries loyalty programme and subject to acceptance of these general terms and conditions. Membership of the Mes Galeries loyalty programme is free and open to any individual over 15 years of age, acting in a personal capacity, residing in a European country (Albania, Germany, Andorra, Armenia, Austria, Belgium, Belarus, Bosnia and Herzegovina, Bulgaria, Croatia, Denmark, Spain, Estonia, Faroe, Finland, France, Georgia, Gibraltar, Greece, Hungary, Ireland, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Macedonia, Malta, Moldova, Monaco, Montenegro, Norway, Netherlands, Poland, Portugal, Czech Republic, Romania, United Kingdom, Russia, Saint Martin, Serbia, Slovakia, Slovenia, Sweden, Switzerland, Turkey, Ukraine, Vatican).
Membership will only be registered if the mandatory information requested is complete and usable.
Galeries Lafayette reserves the right to carry out, at any time, any checks that may prove necessary concerning the identity and/or contact details of the candidates for membership. Any change in the personal data communicated for the needs of membership of the Mes Galeries loyalty programme must be notified as soon as possible by going to the Customer Relations departments of the Stores, by calling 09 69 39 75 75 (standard rate call) or by writing to email@example.com.
5. Terms of membership
Membership of the Mes Galeries loyalty programme can be carried out directly at the check-out, at the Customer Relations Department of the Stores or on the Website. This will be proposed automatically at the time of the creation of the member’s Galeries Lafayette account or accessible later, in the “Loyalty Programme” section.
To join the loyalty programme, you must enter your title, surname, first name, date of birth, a valid email and/or a valid mobile phone number. As the loyalty programme is dematerialised, any member wishing to obtain a physical loyalty card in addition to their virtual card will be able to collect it free of charge, directly from the Customer Relations Departments of the Stores.
No application for loyalty scheme membership may be made by telephone, post or email.
The Mes Galeries loyalty programme contains a personal identification number that is assigned to the member. It is strictly individual and named. Each customer can only subscribe to one membership, and may only have one account in his or her name. If Galeries Lafayette finds that a person holds several loyalty accounts/cards, Galeries Lafayette reserves the possibility of terminating the loyalty account of the member and this will result in the elimination of all their benefits.
6. Loyalty Programme Content
The loyalty programme allows each member, after identification with their loyalty account or presentation of their loyalty card and a valid identity document:
– to accumulate points when making purchases in all the Stores and on the Website (1).
– to have other one-off or recurring benefits in all the Stores and on the Website (2).
1) Points and vouchers
a. Accumulation of points
The accumulation of points presupposes the prior identification of the member, made with each purchase, by identification with his or her loyalty account.
In Stores, identification is possible on presentation of a physical loyalty medium, or on presentation of the virtual loyalty card appearing on the member’s loyalty account or by giving his or her surname/first name/email/mobile phone number.
Identification is possible on the Internet by connecting to the Galeries Lafayette customer account. Points are calculated according to the scale in force.
The scale, currently applied, is 1 point for 1 euro of purchase made in Stores and on the Website (excluding purchase amount paid with one or more purchase vouchers, list services, Le Voyage, catering, services, purchase of gift card and other indicated exceptions), under the conditions set out in these general terms and conditions of sale. However, a monthly purchase total above the sum of 3,000 euros will not give access to points above the said sum. Galeries Lafayette may change the points scale at any time. Information on changes to the scale will be indicated on the member’s loyalty account. Validated points are available immediately after purchase for purchases made in Stores, except for technical unavailability. For purchases made on the Website, the points are available at the time of the complete shipment of the order. For orders made in Stores, points are available at the time of delivery of the goods. Points issued have no market or asset value and are non-transferable.
Payment by way of purchase vouchers shall not entitle the holder to any accumulation of points relating to said purchases.
b. Period of validity of the points
Points are valid for 12 months from the last transaction made on the customer’s loyalty account. If no purchase is made for 12 months from the last purchase made, the points balance will be automatically reset to zero. The cumulative points are rounded up to the next euro and take into account the amount of purchases paid by the member, net of discounts and reductions. If a member has not been able to prove his or her membership of the loyalty programme, he or she may go to the Customer Relations Departments of the Stores within a maximum period of 30 days to assert his or her point rights upon presentation of the receipt.
c. Generating purchase voucher(s)
At each threshold of 300 points accumulated on the loyalty account, a €10 voucher will be automatically credited to the member’s loyalty account and the member may be notified by email and/or SMS. This voucher will be available on D+1 and will be valid for 2 months from its availability on the loyalty account and must be used before the end of this period.
d. Use of purchase voucher(s)
Payment by way of purchase vouchers shall not give rise to any accumulation of points relating to said purchases made in this way.
The voucher allows the member to pay for his or her purchases including on the red dots in all the Stores and on the Website, excluding services, catering, Le Voyage and other indicated exceptions. The use of vouchers is limited to 10 per month. Purchase vouchers can be combined when used – up to 10 vouchers on the same till receipt. The vouchers are named, non-transferable, indivisible and are not convertible in kind or in euros. It is possible to settle purchases whose amount is less than the amount of the purchase voucher, but no change in cash or credit note will be given. Payment by purchase voucher(s) may be supplemented by any other means of payment (gift card, cash, payment by bank card). Purchase vouchers are used upon presentation of the member’s virtual or physical loyalty card. A valid identity document may be requested.
e. Consultation of the number of points and purchase voucher(s) acquired.
The number of points and purchase voucher(s) acquired will be available in the “My account” section on the Website, or from the Customer Relations Departments of the Stores or by calling 09 69 39 75 75 (standard rate call).
Thanks to the electronic loyalty programme, members have permanent and secure access to all their personal information via their Website identifiers. Their contact details, points, purchase orders and order tracking can be consulted in-store, but also online on the Website, provided they have activated a digital account.
f. Cancellation of points and purchase voucher(s)
Points relating to a purchase subject to a refund or return of goods shall be cancelled and removed from the member’s loyalty account.
For purchases made in Stores, in the event of a refund of an item purchased in Stores that has enabled one or more purchase vouchers to be obtained, if the generated purchase voucher(s) have not been used, they will be automatically cancelled. If the vouchers have been used, the loyalty account will be reduced by the number of points corresponding to the amount of the returned item.
As a result, the cumulative balance of points on the loyalty account may be negative. As long as the balance of a member’s points is negative, the vouchers will not be generated. The vouchers already available will be converted into points until a positive balance of points is reached.
In the event of the return of an item purchased in the Stores or in the event of the cancellation of a down payment, paid with one or more purchase vouchers, the reimbursement of the purchase voucher(s) used will be made by credit note or gift card(s). The purchase vouchers will not be re-credited to the loyalty account. No change in cash will be given.
In the event of the return of an item purchased on the Website, paid with one or more purchase vouchers, the vouchers will be automatically re-credited to the member’s account with the original conditions (value and validity date) unless the amount to be returned is less than the amount of the purchase voucher(s), in which case the refund will be made using the original means of payment.
If the validity date of the voucher has expired at the time of reimbursement, the purchase voucher will not be re-credited to the member’s account, and the amount of the voucher will not be able to be reimbursed by any other means. Any point unduly received by the member shall be automatically debited from their account by Galeries Lafayette.
2) Other benefits of the Mes Galeries loyalty programme
The member of the Mes Galeries loyalty programme may benefit from specific one-off or recurring benefits, after identification with their loyalty account. Unless otherwise indicated, the offers in the programme are not applicable to red dots and cannot be combined with the other offers or current benefits announced in the Stores and/or on the Website. The benefits and the conditions for obtaining them are presented in the Customer Relations Departments of the Stores and on the Website. These benefits include:
– Access to Avant-Premières.
– Access to Private Sales.
– Exchange without receipt.
The member is informed of this in the welcome email for the programme sent at the time of joining or, in due course, by post and/or email and/or SMS and/or by display in the Stores or the Website. Differentiated benefits have been introduced for the best customers of the Mes Galeries loyalty programme. Accessibility to these statuses is not automatic once the criteria have been obtained. Galeries Lafayette periodically provides access to the various statuses. A distinction is made between benefits of the loyalty programme (for members who have accumulated €0 to €2,999 in purchases* over 12 months), Premium benefits (for those who have accumulated at least 2 visits and €3,000 in purchases* over the last 12 months) and Exceptional benefits (for members who have accumulated at least 2 visits and €6,000 in purchases over the last 12 months). Members have access to Premium or Exceptional benefits for a period of one year. On this expiry date, Galeries Lafayette may carry out a new calculation; if the member no longer meets the eligibility criteria, they may no longer claim Premium or Exceptional benefits. *excluding purchases made at Louis Vuitton and excluding purchases credited at a later date.
7. Duration of membership of the loyalty programme – Termination procedures
In the event that the member does not use the loyalty programme for 3 years, they will no longer receive marketing prospection emails from Galeries Lafayette.
If a member wishes to terminate their loyalty programme membership agreement, they simply have to request it from the Customer Relations Departments of the Stores or send a written request to Armatis LC Commercialisation, Galeries Lafayette, 6 Boulevard Nicéphore Niepce, BP 80 210, 86 963 Futuroscope Cedex or call 09 69 39 75 75 (standard rate call) specifying the reason for the request.
Any fraud, suspicion of tangible fraud, misuse and/or non-compliance with these general terms and conditions and in particular in the event of fraudulent, abusive or misappropriated use of an abnormally high number of transactions or, more generally, any breach of these general terms and conditions of use may, at the discretion of Galeries Lafayette, automatically result in the definitive termination of the loyalty programme with blocking of the loyalty account and loss of all the rights and benefits attached thereto, without giving the right to any compensation. In order to avoid any risk of fraud in the use of the loyalty account, Galeries Lafayette has put in place permanent control and monitoring systems.
8. Modification/Discontinuation of the Mes Galeries loyalty programme
The Mes Galeries loyalty programme may be suspended, modified or cancelled in whole or in part without notice. Galeries Lafayette may, in particular, change their points scale at any time. No modification, including the removal of the Mes Galeries loyalty programme, will entitle the member to compensation. In the event of the end of the loyalty programme, Galeries Lafayette will inform its members by means of information in the stores, and/or on the member’s loyalty account and/or by means of dedicated communication.
9. Mes Galeries loyalty programme anomaly/malfunction
Galeries Lafayette may not be held liable for the direct or indirect consequences of any operating anomalies in the loyalty programme that are independent of their
desire or that may relate to benefits enjoyed by members, regardless of the cause of these anomalies.
10. Loss/Theft of the Galeries Lafayette card
The member is solely responsible for his/her card. In the event of the loss or theft of the Galeries Lafayette loyalty card, the member must go to the Customer Relations Department of his/her Store or call 09 69 39 75 75 (standard rate call) specifying the reason for the “stolen/lost card”. S/He will then be given a new card. The points on his/her old card are kept on his/her Mes Galeries loyalty account. Between the time when the card has been lost or stolen and the time when the declaration of loss or theft is made, Galeries Lafayette cannot be held liable for the fraudulent use of the benefits credited to the account and no refund or reclaiming of points will be permitted, the member will also lose the possibility of using the cumulative points as well as all other benefits associated with the card over the period.
11. Complaints – Information
For any information, complaint or question relating to the loyalty programme, the member is invited to call 09 69 39 75 75 (standard rate call) or to go to galerieslafayette.com in the Help and Contact section. Galeries Lafayette is a member of the FEVAD (Fédération des Entreprises de vente à Distance). In this respect, Galeries Lafayette agrees to honour the Customer respect rules contained in the professional code of the FEVAD Quality Charter. In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, Galeries Lafayette adheres to the e-commerce Ombudsman Service of the FEVAD (Federation of e-commerce and distance selling) whose contact details are as follows: 60, rue La Boétie – 75 008 Paris – http://www.mediateurfevad.fr. 12. Protection of privacy
Personal data collected as part of joining the Mes Galeries loyalty programme is mandatory and necessary to enable the programme to work.
44 Galeries Lafayette is responsible for the processing of Data.
44 Galeries Lafayette and/or the independent affiliated companies operating stores under the Galeries Lafayette or Nouvelles Galeries brand receive the data collected.
Authorised subcontractors may also be sent all or part of the data collected in the context of advertising targeting services and/or carrying out surveys or creating statistics. The data will be entrusted by the data controller by means of strictly regulated data transfers to ensure a level of security and confidentiality that complies with the regulations.
You have, at any time, an individual right to access, rectify or delete your personal data as provided for by law, which you may exercise as follows:
– either by modifying your personal information yourself in the “My Account” area accessible on the Website,
– or by contacting customer service and making a request to change or delete your customer data,
– or by making the request by email to firstname.lastname@example.org.
Depending on the choices made when creating or consulting your account, you may agree to receive commercial offers from Galeries Lafayette and/or its Partners, or be informed of specific transactions via email and/or sms.
If you no longer wish to receive these offers, you may, at any time, request that you no longer receive them by clicking on an electronic unsubscribe link available on the emails, stop sms for this purpose, or by modifying your account settings directly on the Website.
Galeries Lafayette shall not be held liable if the non-performance or poor performance of its obligations is attributable to the member of the loyalty programme, or to a case of force majeure.
14. Partial invalidity – Modification of the general terms and conditions
If one or more provisions of these general terms and conditions were held to be illegal or invalid, such invalidity shall not have the effect of invalidating the other provisions of these terms and conditions. Galeries Lafayette reserves the right to adapt or modify these general terms and conditions at any time and without notice, any adaptations or modifications being applicable to any use of the loyalty programme subsequent to these adaptations or modifications.
15. Disputes – Applicable Law – Competent Jurisdiction
These general terms and conditions are subject to application of French law. Only the French version of these general terms and conditions of use of the Mes Galeries loyalty programme is authentic. Any dispute that may arise from the interpretation or performance of these general terms and conditions and the consequences thereof shall be brought before the competent courts.
