1. Store identification 

Unless otherwise specified, the author of the offer and the seller of the products and services offered in-store is: 

Galeries Lafayette Champs Elysées, a French société par actions simplifiée (simplified limited company) with share capital of €50,000, whose registered office is at 27 rue de la Chaussée d’Antin, Paris 9th arrondissement, registered in the Paris Trade and Companies Register under number 824 041 610, for its store located at 52-60 avenue des Champs-Elysées in Paris.

Galeries Lafayette offers for sale products and services intended for individuals purchasing one or more products for their personal needs and not intended for resale. Galeries Lafayette reserves the right to refuse the sale in the event of suspected purchases that do not fall within this scope. 

The purpose of these general terms and conditions of sale is to define the rights and obligations of Galeries Lafayette and its customers in connection with in-store sales. 

Any purchase in the store implies the pure and simple acceptance of these general terms and conditions of sale, which are available in the Lobby/Concierge Area of the store and on the website, galerieslafayettechampselysees.com

 

2. Price and payment 

The applicable price of products for immediate pick-up by the customer is indicated in the store in euros inclusive of VAT, and confirmed when the customer goes through the checkout. The store is not required to apply the prices recorded in other stores and on the Internet. 

Payment is made in cash in accordance with the payment methods and currencies accepted and communicated at the till. Payment in foreign currency incurs costs to be borne by customers. 

In accordance with Decree no. 2015-741 of 24 June 2015, payment in cash is limited to the sum of €1,000 for French residents and €15,000 for non-residents. These limitations also apply to payment by gift card. 

The presentation of official and valid proof of identity may be required, where applicable, during payment.

 

3. Promotions and rules of cumulation 

Promotions and benefits cannot be combined with one another unless otherwise stated. Some promotions may be reserved for part of the customer base; the conditions for accessing these offers are available in-store. 

 

4. The services offered in-store 

The terms and conditions of the services are available within the store in the Lobby/Conciergerie Area (and on galerieslafayettechampselysees.com.)

Unless otherwise indicated, the products entrusted in the context of these services must be withdrawn by the customer no later than 2 months from the date of deposit of the goods; otherwise, Galeries Lafayette shall no longer be responsible for their safekeeping. 

The tax refund is a service that is accessible according to the conditions defined in the store, for customers who are eligible for it in accordance with French and Community legal provisions.

 

5. Exchange and reimbursement of products 

Unless otherwise indicated, it is possible to return an unused product to the store, with its original packaging, up to 30 days after purchase and upon presentation of the receipt or invoice. 

After verification and, where applicable, assessment of the product, the product will be reimbursed using the same payment method. 

It should be specified that in the event of payment by gift certificate or gift card (multi-brand or single-brand), reimbursement will be made by Galeries Lafayette gift card. 

A product may have been tried on, but not worn. Any incomplete, spoiled, used, damaged, deteriorated, soiled or even partially consumed product may not be exchanged or reimbursed. 

Products that have been exchanged or reimbursed must be able to be returned for sale.

Certain items do not benefit from this offer and without limitation: 

– products that have been the subject of a special order or that have been altered or that have been personalised, 

– lingerie items (without their protection), shoes missing their box, bedding removed from its packaging, audio or video recording devices or unsealed software, earrings, etc.

– jewelery and watchmaking items

 

6. Warranties

Legal warranty: 
All products sold in the store benefit from the statutory guarantee of conformity. 

Galeries Lafayette is liable for non-conformities in the products sold in the store under the conditions of Article L. 217-4 et seq. of the Consumer Code and hidden defects in the property sold under the conditions provided for in Articles 1641 et seq. of the Civil Code.

When the customer acts as legal guarantee of conformity:

– S/he benefits from a period of 24 months from the delivery of the product to act. 

– S/he may choose between repairing or replacing the property, subject to certain cost conditions provided for by Article L 217-9 of the Consumer Code. 

– Proof of the non-conformity is not required to be provided during the 24 months following delivery of the property. 

The statutory guarantee of conformity applies regardless of the commercial warranty that may be granted.

It is recalled that the customer may decide to implement the guarantee against defects in the property sold within the meaning of Article 1641 of the Civil Code In this case, the consumer can choose between terminating the sale or reducing the price. 

 

Commercial Warranties: 
In addition to the statutory guarantee, certain products may benefit from the commercial warranty offered by their manufacturer to which Galeries Lafayette is not a party. The extent and duration of this warranty varies depending on the manufacturer. The terms of these warranties can be found on the manufacturer’s website and/or in the product information.

To be able to benefit from the commercial warranty, the customer must contact the brands that have granted the commercial warranty.

Galeries Lafayette shall not be held liable if the manufacturer refuses to apply its commercial warranty.

 

7. Spare parts

Unless expressly specified on the product, Galeries Lafayette has not been informed of the availability of any spare parts. 

 

8. Taking back of electrical products – 1 for 1

Pursuant to the provisions of Article R 543-180 of the Environmental Code, if a customer purchases an electrical or electronic household product, Galeries Lafayette takes back the used electrical or electronic equipment that the customer discards free of charge, within the limit of the quantity and the type of equipment sold.

Galeries Lafayette may refuse to take back electrical and electronic equipment which, following contamination, presents a risk to the health and safety of its staff.

In this case, Galeries Lafayette may propose an alternative solution.

 

9. Complaints and mediation service

Any complaints must be sent to the store’s customer service department at the address specified below, which is responsible for processing and following up the complaints.

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, Galeries Lafayette is a member of the e-commerce ombudsman service of the FEVAD (Federation of e-commerce and distance selling) whose contact details are as follows: Médiation FEVAD, 60 rue la Boëtie, 75008 Paris.

10. Personal data and telephone prospecting

Galeries Lafayette attaches great importance to the protection of personal data. 

Personal data may be collected during the visit to the store and may be used by Galeries Lafayette for statistical purposes to enable them to better understand their customers and improve the quality of service. 

If the customer has accepted it, the personal data collected is also processed by Galeries Lafayette for the purpose of communicating commercial offers and/or improving and personalising customer relationship monitoring. Only the company Galeries Lafayette Champs-Elysées and the companies of the Galeries Lafayette Group, and/or its partners if the customer has accepted it, receive the information communicated. 

Some of the information may be transferred securely outside the European Union (USA) to reference service providers, in particular to conduct customer surveys.
